Informed Consent, Waiver and Liability Release
Mid-Winter Retreat (Unincorporated Association)
Please read carefully before signing. This is a release of liability and your informed waiver of certain legal rights.
By registering for this event of the Mid-Winter Retreat (MWR), at a venue which may or may not be under its control, I agree to the following Waiver and Release:
I acknowledge that there are inherent hazards, dangers and risks at MWR being held that cannot be eliminated. I understand that these risks, hazards and dangers may include, without limitation:
1. Hazards such as surface and sub-surface conditions, including, but not limited to, snow and ice;
2. The potential for me to act in a negligent manner that may contribute to injury to myself or others. I may encounter variations in terrain that are my responsibility, and I assume these risks whether they are obvious or not obvious, man-made or natural;
3. Hiking or snowshoeing in rugged and possibly snow or ice-covered country;
4. Encounters with wildlife, animals and insects;
5. Temperature extremes and or inclement weather conditions;
6. Unavailability of immediate medical attention in case of injury;
I acknowledge having had the opportunity to discuss the risks and hazards with MWR organizers. I understand that accidents can be the result of the nature of the activity and can occur without any fault on the part of the myself, MWR organizers or the venue of the gathering.
I HEREBY ASSUME AND ACCEPT ANY AND ALL RISKS.
I, for myself, my heirs, successors, executors and subrogees, hereby KNOWINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS MID-WINTER RETREAT, ITS ORGANIZERS AND VOLUNTEERS, AND THE VENUE AT WHICH THE MWR IS HELD, their directors, officers, agents, employees, property owners and volunteers from and against any and all claims, actions, liabilities, law suits, expenses (including reasonable attorney fees) which are related to, arise out of, or are in any way connected with my attendance at MWR, including, but not limited to NEGLIGENCE of any kind or nature, whether foreseen or unforseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of my engaging in any activities or in the use of services or equipment of MWR and its venue, whether such damage, loss, injury, paralysis, or death results from negligence of MWR or from some other cause.
I, for myself, my heirs, my successors, executors, and subrogees, further agree not to sue MWR, its organizers or venue as a result of any injury, paralysis, or death suffered in connection with my use of services and participation in the MWR.
